1. SCOPE OF AGREEMENT & USER ELIGIBILITY

1.1. Operator of the Service: The website lootgate.net is owned and run by DOM POUCH LTD, a company registered in England and Wales under registration number 17380032, whose registered office is at 4 Cavendish Square, London W1G 0PG.

1.2. Age Threshold: To use this website or carry out any transaction on it, you must be at least 18 years old, or have reached the age of majority set by the laws of your own country, whichever is higher.

1.3. Legal Capacity: By making use of our services you confirm that you are legally able to enter into contracts that are binding on you.

1.4. Acting for a Company: Anyone who accesses the site on behalf of a business or other organisation confirms that they are properly authorised to accept these Terms on that organisation's behalf.

1.5. Identity Checks: Access to certain features may depend on passing our "Know Your Customer" (KYC) checks, which verify identity and age. Additional checks may apply depending on the country you are in.

1.6. Accuracy of Information: You may not give us false, misleading, or incorrect information at any point, and you alone are responsible for any consequences that result if you do.

1.7. Regional Availability: The site can be used from almost anywhere, except in countries subject to international sanctions. It is your responsibility to check that using our services does not break any law that applies to you.

2. WHAT THE PLATFORM DOES

2.1. Purpose of the Site: lootgate.net is a marketplace where users can buy and sell in-game skins and other virtual items, with delivery handled through Steam trade offers.

2.2. Delivering Items: Once a purchase has been paid for and confirmed, the relevant item is sent straight to the buyer's linked Steam account.

2.3. What We Do and Don't Do: Our role is limited to arranging delivery and resale of these digital items — we are not the creator, publisher, or host of any skin.

2.4. Handling of Payments: All payments are processed through licensed, regulated payment providers.

3. RULES OF USE & FORBIDDEN BEHAVIOUR

3.1. No Illegal Use: You may not use the platform for anything unlawful, including — but not limited to — laundering money or getting around sanctions.

3.2. No Interference: Trying to disrupt, hack, or otherwise undermine the security or stability of the site is not allowed.

3.3. No Automated Access: Bots, scrapers, and other automated tools may not be used to access or extract data from the site unless we have given prior written approval.

3.4. No Payment Abuse: Abusing the chargeback system, using stolen or unauthorised card details, or trying to move on items obtained through fraud is strictly forbidden.

3.5. Other Restrictions: You also may not create fake accounts, resell items you're not entitled to, try to get around withdrawal limits or country restrictions, or send funds to third-party accounts that haven't been verified.

3.6. Consequences: Breaking any of these rules can result in your account being suspended right away, your balance being frozen, and, where appropriate, a report being made to the relevant authorities.

4. YOUR ACCOUNT & ITS SECURITY

4.1. Logging In: The only way to access your dashboard is by signing in through Steam.

4.2. Keeping Details Current: You must keep the information on your profile complete, correct, and up to date at all times.

4.3. Responsibility for Your Account: You are responsible for keeping your login details safe and for everything that happens on your account.

4.4. Our Right to Suspend or Close Accounts: We may suspend or close your access at any time if we believe your account is being misused, involved in fraud, or otherwise abused. Once we do this, your right to use the service ends immediately.

5. PLACING ORDERS & PAYMENT

5.1. What Placing an Order Means: When you place an order, you're agreeing to pay the full price shown, plus any applicable fees or taxes.

5.2. How Prices Work: Every price on the site is shown in euros (€), and we may change prices at any time without notifying you beforehand.

5.3. Ways to Pay: You'll see the accepted payment options — such as certain debit or credit cards, and PayPal — at checkout.

5.4. Payment Security: Payments are handled by third-party providers who comply with PCI DSS standards. DOM POUCH LTD itself never holds or has direct control of your money.

5.5. Suspicious Transactions: Any purchase made with a stolen card or unauthorised payment method will be cancelled straight away and reported to the appropriate parties.

5.6. Our Right to Cancel an Order: We may, at our discretion, cancel an order if we spot a pricing error or suspect fraudulent activity.

6. HOW ITEMS ARE DELIVERED

6.1. Triggering Delivery: As soon as your payment clears, we automatically send the item to you via a Steam trade offer.

6.2. How Long It Takes: Delivery is usually completed within 7 days, though technical issues can occasionally push this out to 14 days. If we go beyond 14 days, you're entitled to either a free replacement delivery or a full refund.

6.3. What We Need From You: For delivery to succeed, you need a working trade URL, both Steam Guard and the Mobile Authenticator switched on, and a Steam account that can trade — meaning no bans, holds, or privacy settings that would block the trade.

6.4. What We're Not Responsible For: We are not liable if delivery fails because of an incorrect trade link, an inventory that's reached its limit, or restrictions imposed by Steam itself.

7. SELLING ITEMS & GETTING PAID

7.1. Listing Rules: Any item you list for sale must meet our category requirements and will be reviewed internally before it goes live. We can reject a listing outright, without explanation, if it looks fraudulent or high-risk.

7.2. Where Your Items Stay: Your items stay in your own Steam inventory until someone buys them; once sold, you must transfer them exactly as we instruct. Not following that process may lead to limits being placed on your account.

7.3. Our Cut: We take a 10% commission on every completed sale.

7.4. When You Get Paid: Once delivery of the sold item is confirmed, our payment partners generally send your money within 3 to 7 business days — though compliance checks or provider delays can occasionally stretch this out.

7.5. Minimum and Maximum Payouts: We only process payouts between €10 and €5,000. Anything outside that range will be rejected, and we may change these limits whenever we choose.

7.6. Getting Your Payment Details Right: It is entirely up to sellers to make sure the payout information they give us is correct.

7.7. When a Payout Can Be Reversed or Refused: We can reverse or refuse a payout if the item wasn't properly delivered, if we suspect fraud, if the item itself was invalid, if funds are missing, if the withdrawal method isn't supported, or if the seller is based somewhere we don't operate in. If this happens, we'll let the seller know.

7.8. Ongoing Monitoring: We keep a close eye on activity across the platform for compliance and chargeback risks. If something looks suspicious, we may hold back or cancel a payout permanently.

7.9. Protecting Your Data: Sensitive payout information is safeguarded under GDPR and PCI DSS rules, and you can always check your payment history from your dashboard.

8. CANCELLING ORDERS & GETTING REFUNDS

8.1. Waiving the Cooling-Off Period: In line with the UK Consumer Contracts Regulations 2013, you give up your usual 14-day right to cancel as soon as you agree to have your digital item delivered immediately.

8.2. Cancelling Before Delivery: You can only cancel an order by emailing info@lootgate.net before your payment has actually gone through. If a trade hasn't been completed yet, we may also be able to refund it once we've checked the details.

8.3. Once It's Delivered: After a digital item has been accepted on Steam, it can no longer be refunded, unless local law says otherwise.

8.4. Refunds for Non-Delivery: If an item is never delivered, you can request a refund within 30 days of your original purchase.

8.5. Checking for Fraud: Every refund request is looked into before it's approved. We may withhold payment or turn down a refund if we think there's been fraud or abuse.

8.6. How Refunds Are Paid: Once approved, refunds are sent back to your original payment method within 14 days at the latest.

8.7. When Payouts Might Be Held Up: We follow consumer protection law, but we may still delay or cancel a payout if a bank rejects it or if one of our internal rules has been broken — in either case, we'll notify the user.

9. INTELLECTUAL PROPERTY

9.1. Who Owns Our Content: Everything on lootgate.net — images, text, logos, and the code behind the site — belongs to us or to whoever licenses it to us, and is protected by UK and international intellectual property law.

9.2. Third-Party Trademarks: Any TF2-related trademarks or assets belong solely to Valve Corporation; we are not affiliated with, sponsored by, or endorsed by Valve in any way. All other trademarks belong to their respective owners.

9.3. Our Actual Role: We simply help move existing digital items between users via Steam — we don't create or own the items themselves.

9.4. No Copying: You may not copy, adapt, redistribute, or create new works based on anything from the site without getting our permission first.

10. LIMITS ON OUR LIABILITY

10.1. No Guarantee of Perfection: We try to keep the site running smoothly at all times, but we can't promise it will always be free of errors or interruptions.

10.2. What We're Not Liable For: To the extent the law allows, lootgate.net isn't responsible for financial losses, missed business opportunities, damage to reputation, or any other indirect losses arising from your use of the site. This doesn't apply to liability for fraud, injury, or death, which we never exclude.

10.3. Things Outside Our Control: We're not responsible for changes in an item's market value, whether it stays usable in future, or any disruptions or bans that Valve or Steam might impose.

10.4. Your Responsibility to Us: If you break these Terms, act fraudulently, misuse chargebacks, or breach a regulation, you agree to cover any legal costs, claims, or liabilities that we, our staff, or our affiliates face as a result.

11. HOW WE HANDLE YOUR DATA

11.1. Our Role as Data Controller: DOM POUCH LTD acts as the Data Controller under UK GDPR, and only processes your data where necessary for legal compliance or to fulfil your order.

11.2. Where to Find the Details: The full picture of how we handle your information is set out in our Privacy Policy; using our services means you accept those terms.

11.3. Why We Collect Data: We use the information we collect to process payouts, detect fraud, meet anti-money-laundering obligations, and carry out KYC checks.

11.4. Sharing With Others: To do the above, we may need to share some personal data with trusted payment partners.

11.5. Your Rights Over Your Data: Under data protection law, you have the right to ask us to delete, correct, restrict, or give you access to your personal information.

12. LEGAL JURISDICTION, DISPUTES & CHANGES TO THESE TERMS

12.1. Which Law Applies: These Terms are governed solely by the law of England and Wales.

12.2. Where Disputes Are Heard: Legal disputes will be dealt with by the courts of England and Wales, while purely payment-related disputes may also fall under the rules of the relevant payment processor.

12.3. Talking It Through First: Before taking any legal action, you agree to first try to resolve the issue through our support team.

12.4. Making a Complaint: Complaints can be sent to info@lootgate.net, and we aim to deal with them within 14 business days. Consumers in the EU and UK can also use the Online Dispute Resolution (ODR) platform if they wish.

12.5. Changing These Terms: If we make any significant changes to these Terms, we'll give you at least 7 days' notice beforehand. Continuing to use the site after that point means you accept the updated Terms.
